Oppdragsgiver har dermed ikke mulighet til å tildele kontrakt innenfor rammene av den kunngjorte konkurransen. Konkurransen avlyses derfor, i henhold til anskaffelsesforskriften § 10-4. Avlysningen er saklig begrunnet i forhold som er avdekket under konkurransegjennomføringen, og som innebærer at det ikke foreligger et gyldige tilbud som grunnlag for kontraktsinngåelse.   Begrunnelse for å ikke vekte miljø som tildelingskriterium (30 %) Hovedregelen i offentlige anskaffelser er at klima- og miljøhensyn skal vektes minimum 30 % under tildelingskriteriene. Etter forskrift om offentlige anskaffelser § 7-9 fjerde ledd kan miljø som tildelingskriterium erstattes med krav dersom det er klart at dette gir bedre klima- og miljøeffekt. Tromsø kommune har, i samsvar med anskaffelsesforskriften (FOA) § 7‑9 foretatt en helhetlig vurdering av hvordan klima‑ og miljøhensyn best kan ivaretas i denne anskaffelsen. Vurderingen er basert på identifiserte miljøbelastninger, tilgjengelige tekniske løsninger, markedets modenhet samt de særskilte rammene som følger av at oppdraget skal utføres i et vernet bygg. Vurderingen viser at prosjektets klima‑ og miljøbelastning i hovedsak er knyttet til materialbruk, særlig produksjon av stål, maskinbruk på byggeplass, herunder mobilkran, og energibruk og utslipp knyttet til unødvendig tomgang. For konstruksjonsstål til bygg og infrastruktur vil en høy andel resirkulert materiale har svært liten eller ingen negativ påvirkning på kvalitet, styrke eller bruksområde. Ved å stille konkrete krav til høy andel resirkulert stål, lav maksimalverdi på klimagassutslipp og dokumentasjon gjennom miljødeklarasjoner (f.eks. EPD), vil det medføre at betydelige utslippsreduksjoner kan oppnås uten at det går på bekostning av tekniske eller sikkerhetsmessige krav. Ved i tillegg å stille krav til utslippsfri eller elektrisk drift ved løfteoperasjoner og forbud mot tomgangskjøring på byggeplass, etableres et minimumsnivå som bidrar til reduksjon av prosjektets samlede klimaavtrykk. De absolutte kravene anses å være relevante og forholdsmessige ved at de retter seg direkte mot de vesentligste klima- og miljøbelastningene i prosjektet, og ved at de er tilpasset prosjektets omfang og markedets leveranseevne. Etter vår vurdering er klima- og miljøkravene i konkurransen satt på et nivå som gir klart bedre klima- og miljøeffekt enn å benytte miljø som tildelingskriterium i denne anskaffelsen. På denne bakgrunn er Tromsø kommunes vurdering at vilkårene for å benytte unntaksregelen er oppfylt, og at denne tilnærmingen gir best klima- og miljøeffekt. Tromsø kommune vurderer derfor at unntaket i FOA § 7-9 fjerde ledd kommer til anvendelse.
