Prisskjema kan ikke endres slik uten at dette utgjør en vesentlig endring av konkurransegrunnlaget. Konkurransen må derfor avlyses. Oppdragsgiver vil snarlig kunngjøre en ny konkurranse om utbedringen av tilfluktsrommene, med et prisskjema oppdatert med generelle priser for tjenestene samt enhetspriser for utbedringen med estimater per tilfluktsrom. Innkomne spørsmål vil hensyntas og svares ut i ny konkurranse. Vi oppfordrer dere til å delta i ny konkurranse om anskaffelsen og håper dere har anledning.

Som hovedregel skal klima- og miljøhensyn vektes med minimum 30 %. Dersom krav klart gir en klart bedre klima- og miljøeffekt, kan dette erstatte bruk av tildelingskriterie, jf. fjerde ledd. Forpliktelsen til å stille krav eller kriterier etter bestemmelsen gjelder ikke dersom anskaffelsen etter sin art har et klimaavtrykk og en miljøbelastning som er uvesentlig, jf. femte ledd. Den aktuelle anskaffelsen gjelder vedlikehold og utbedring av tilfluktsrom. Majoriteten av utslippene i livsløpet til et tilfluktsrom tilskriver seg til drift og vedlikehold samt tilvirkning og materialutvinning. Det er imidlertid ikke hensiktsmessig å evaluere på bakgrunn av det, da det er utfordrende å skille leverandørene på dette. Kravene til utførelse er tydelig regulert i gjeldende forskrifter fra Sivilforsvaret og DSB, noe som vanskeliggjør variasjon i leveransen. Oppdragsgiver vurderer at anskaffelsens klima-og miljøbelastning utover dette er knyttet til transport til og fra oppdragssted, samt håndtering av avfall og materialer i forbindelse med utførelsen. Disse forholdene er konkrete, identifiserbare og egner seg godt for regulering gjennom krav i kravspesifikasjonen og kontrakten. Det vil ikke forekomme massetransport, slik at premiering av utslippsfri massetransport ikke vil gjennomføres. Markedsundersøkelser viser at markedet er modent for minimumskrav om bruk av nullutslippskjøretøy for gjennomføring av oppdrag. Det vurderes at det gir en klart bedre klima- og miljøeffekt å innta krav i kravspesifikasjonen enn tildelingskriterier. Dette gjennomføres ved en henvisning fra kravspesifikasjonen til relevante bestemmelser i kontrakten. Miljø vil derfor ikke benyttes som et selvstendig tildelingskriterium i denne konkurransen.
