Flere leverandører gir uttrykk for at de forventer tydelige og relativt strenge miljøkrav. Dette underbygger at markedet er innstilt på betydelig vektlegging av miljø, og at et høyt minstekrav om nullutslippsbusser oppfattes som et legitimt virkemiddel. Samtidig viser markedsdialogen at enkelte leverandører per i dag ikke har nullutslippsbusser, men kan mobilisere slikt materiell med noe tid. Dette tilsier at et krav om 90 % nullutslippsbusser bør knyttes til faktisk leveranse over tid, slik som andel kjørte kilometer i avtaleperioden, og at man dermed også beholder adgang til å håndtere saklige behov for unntak innenfor den begrenset andelen i de resterende 10%. Dersom andel nullutslippsbusser bare inngår som ett av flere tildelingskriterier, kan et tilbud med lavere nullutslippsbusse likevel vinne på grunn av lavere pris eller kombinasjon av lavere pris og god uttelling på andre tildelingskriterier. Det gir risiko for at resultatet ikke reflekterer det miljønivået markedet faktisk kan levere. Et minstekrav er dermed et mer treffsikkert virkemiddel for å oppnå ønsket klimaeffekt enn en relativ poengskala, fratrekksmodell eller annen evauleringsmodell. Minstekravet operasjonaliseres som et krav til andel kjørte kilometer med elbusser over fire år. Dette er enkelt å kontrollere gjennom standard rapportering og tilhørende sanksjonsmuligheter. Et tildelingskriterium basert på andel nullutslippsbusser, gjerne med glideskala og sammensatte vekter med gradvis inkludering over flere år, kompliserer både evalueringen og senere oppfølging. Risikoen øker for at den faktiske leveransen avviker fra det som ble lagt til grunn ved evalueringen. Et minstekrav gir dermed mer etterprøvbare og håndhevbare miljøforpliktelser i kontraktsperioden. Markedsdialogen viser at flertallet av leverandørene kan levere 80–95 % utslippsfri kjøring enten per dags dato eller iallfall med foreslått formulering av minstekravene. Ved å velge et minstekrav kan man dermed kombinere et høyt miljøambisjonsnivå med reell konkurranse og gjennomførbarhet for leverandørmarkedet. Oppsummert Evaluering på utslippsfrie kjøretøy risikerer at tilbud med lavere tilbudt utslippsfri kjøring kan vinne med lavere pris, eller kombinasjonen pris og andre kvalitetselementer, og at miljøgevinsten blir lavere enn det markedet faktisk kan levere. Det er derfor klart at minstekravet gir en bedre klima- og miljøeffekt fordi markedsdialogen viser at flere sentrale leverandører allerede kan levere rundt 90–95 % utslippsfri kjøring. Et krav om minst 90 % kjøring med nullutslippsbusser er dermed både realistisk og egnet til å sikre at dette høye nivået faktisk oppnås.
