  Oppdragsgiver har en plikt etter anskaffelsesloven § 5 til å innrette sin anskaffelsespraksis slik at den bidrar til å redusere skadelig miljøpåvirkning, og fremme klimavennlige løsninger der dette er relevant. Det følger videre av anskaffelsesforskriften § 7-9 at oppdragsgiver som et utgangspunkt skal vekte klima- og miljøhensyn med minimum tretti prosent der kriterier angis med relativ vekting. Oppdragsgiver har i denne kontrakten istedenfor stilt klima- og miljøkrav som etter oppdragsgivers vurdering gir en betydelig bedre klima og miljøeffekt, og har derfor unnlatt å vekte klima- eller miljøhensyn med tretti prosent. Bygg- og anleggsvirksomhet står for en betydelig del av Oslo kommunes direkte utslipp av klimagasser, hvor hovedkildene til denne typen utslipp skyldes anleggsdrift med maskiner og utstyr på anleggsplass og veitrafikk ifm. transport av masser, materialer, avfall og personer. Reduksjon av direkte utslipp har derfor vært- og fortsetter å være - et fokus for kommunens strategi for å redusere klimagassutslipp og legge om til en utslippsfri produksjon ifm. bygg- og anleggsvirksomhet i kommunen. I forhold til gjennomføring av denne kontrakten stilles det en rekke krav til entreprenør som har til formål å redusere den samlede negative klima- og miljøpåvirkningen av kontraktsgjennomføringen. I første rekke er det stilt krav, om at entreprenør skal utføre arbeidet utslippsfritt. Det innbefatter at leverandør må finne- og ta i bruk utslippsfrie løsninger (dvs. batterielektrisk, kabelelektrisk eller hydrogen) på bygge-/anleggsplassen fra byggestart og frem til ferdigstillelse. Blant annet må alle maskiner og alt utstyr som benyttes på bygge-/anleggsplassen være utslippsfritt. Det vil i en slik sammenheng ikke finnes noen reelle eller akseptable alternativer som kunne gitt en bedre klimaeffekt gjennom eventuell meroppfyllelse av kravene. Utslippsfrie maskiner og utstyr har og den fordel at de er langt mindre støyende i bybildet som reduserer lokal støyforurensning. For å redusere utslipp ifm. veitrafikk for tunge kjøretøy er det også stilt krav om at entreprenør for transport av masser til/fra bygge-/anleggsplassen skal benytte biogasskjøretøy som minimum oppfyller euroklasse 6/VI. Kravet gjelder hele transportstrekningen fra uttakssted til anleggsplassen og fra anleggsplass til lovlig avfallsmottak for behandling av massene som tas ut. Sammenlignet med ordinær diesel som fremdeles er svært vanlig, er det klare forbedringer av å stille krav til et klimanøytralt drivstoff og kjøretøy (biogass). Samtidig er euroklasse 6/VI fortsatt den seneste og høyeste standarden for veigående kjøretøy. For kjøretøy med en tillatt totalvekt på inntil 3,5 tonn for transport av varer og tjenester er det et minimumskrav om utslippsfrie løsninger. Dette omfatter de fleste former for persontransport. For denne kategorien er det et utviklet og modent marked, hvor et kriterium ikke vil være egnet å skille tilbudene fra hverandre når utslippsfritt er den mest klimavennlige utslippsteknologien. Kjøretøy for transport av varer og tjenester over 3,5 tonn skal tilfredsstille euroklasse 6/VI og minimum benytte fossilfritt drivstoff. Markedsundersøkelsen viser at det ikke foreligger klare eller dokumenterbare forskjeller i materialegenskaper for dører, porter eller luker. Leverandørene kan heller ikke dokumentere forventet levetid på en måte som muliggjør objektiv sammenligning. Det er derfor ikke grunnlag for å stille krav eller fastsette tildelingskriterier verken for materialvalg eller levetid/garanti. Som et miljøtiltak skal dører som er egnet for rehabilitering, prioriteres for oppgradering fremfor utskifting. Oppdragsgiver vurderer at kravene stilt til entreprenøren er ambisiøse sammenlignet med de fleste anleggsplasser i Norge hva gjelder krav til en lavutslippsgjennomføring. Sammenlignet med bruk av tildelingskriterier hvor oppdragsgiver ikke kan garantere seg disse effektene, er det en iboende risiko for at en elektrisk maskin- og kjøretøyspark ikke kan oppveie for et forsprang andre leverandører oppnår på prispoeng, all tid tradisjonelle fossile maskiner og kjøretøy er rimeligere alternativer hensyntatt investering, drift, infrastruktur og usikkerhet. Kravene reduserer derfor anskaffelsens samlede klimaavtrykk på en måte som klart gir en bedre klimaeffekt hva gjelder direkte utslipp av klimagasser.
