  Oppdragsgiver benytter unntaksbestemmelsen i FOA § 7-9 fjerde ledd første punktum, og har erstattet tildelingskriterier etter andre ledd med klima- og miljøkrav i kravspesifikasjonen. Det vurderes som klart at dette gir en bedre klima- og miljøeffekt, og dette begrunnes nedenfor. Anskaffelsen av nettverks-, server- og lagringsutstyr har som hovedformål å sikre stabil, sikker og fremtidsrettet infrastruktur for kommunale tjenester. IT-utstyr har en vesentlig miljøpåvirkning gjennom materialbruk, produksjonsprosesser, energiforbruk og håndtering ved endt levetid. Bransjen er imidlertid preget av rask teknologisk utvikling, noe som gjør det mer hensiktsmessig å stille spesifikke miljøkrav i kravspesifikasjonen fremfor å benytte klima- og miljø som tildelingskriterium. Markedet for nettverks-, server- og lagringsutstyr domineres av store, internasjonale aktører som allerede har omfattende bærekraftsstrategier. Kravspesifikasjonen sikrer at leverandørene må oppfylle følgende miljøkrav: Miljøledelsessystem: Leverandøren skal dokumentere at de har implementert et miljøledelsessystem sertifisert etter ISO 14001 eller tilsvarende. Rapportering av miljøavtrykk: Leverandøren skal regelmessig rapportere miljøavtrykk for leverte produkter, inkludert energiforbruk og klimagassutslipp. Materialvalg og resirkulerbarhet: Produktene skal så langt det er mulig være laget av resirkulerbare materialer og designet for enkel demontering og resirkulering. Miljømerking av IT-utstyr: Produkter som leveres skal være miljømerket, eksempelvis med Svanemerket, EU Ecolabel (Blomsten), Den Blå Engel eller tilsvarende. Energieffektivitet: Produktene skal oppfylle energieffektivitetsstandarder som Energy-star eller tilsvarende for energieffektiv drift, der dette er relevant. Ved å stille disse kravene som absolutte i kravspesifikasjonen, sikres det at samtlige leverandører oppfyller høye standarder for klima- og miljøhensyn. Dette gir en mer direkte og forutsigbar miljøgevinst sammenlignet med å benytte klima- og miljø som et tildelingskriterium med vekt i evalueringen. Oppdragsgiver vurderer at disse tiltakene vil gi en klart bedre miljøeffekt enn en vekting av klima- og miljø med 30 % i evalueringen, ettersom alle tilbudte produkter må møte kravene uavhengig av pris- og poengberegning. Samtidig reflekterer kravene markedspraksis, hvor de fleste seriøse aktører allerede jobber systematisk med miljøtiltak.
