  Oppdragsgiver tildeler kontrakt for transmisjon i nødnett for fase 0 og 1 iht. historisk utbygging til GlobalConnect AS med hjemmel i forskrift om offentlige anskaffelser legger til grunn at § 13-4 bokstav b nr. 2, jf. at anskaffelsen etter oppdragsgivers vurdering gjelder ytelser som bare denne leverandøren kan levere fordi konkurranse er umulig av tekniske årsaker. Oppdragsgiver vurderer det videre slik at vilkårene i bestemmelsen om at det ikke foreligger rimeligere alternativer og at manglende konkurranse ikke skyldes at oppdragsgiveren har tilpasset anskaffelsesdokumentene til en bestemt leverandør er oppfylt. Det vises til at dagens leveranser av transmisjon fra GlobalConnect AS fungerer sammen med og har nødvendig teknisk kompatibilitet med leveranser fra Motorola i Nødnett. Et eventuelt skifte av leverandør og sikring av teknisk kompatibilitet i denne sammenheng, vil gi oppdragsgiver store byttekostnader i forhold til kontraktsverdien. det vises herunder til at kontrakten er viktig for å opprettholde dagens Nødnett i overgangen til etablering av nytt Nødnett.
