Forsvarsbygg har i den forbindelser behov for å anskaffe et system som kan forenkle oppfølgingen av disse kravene og som gir en god oversikt og kontroll over prosjekter, uavhengig av utførende entreprenør. MarkedsundersøkelseSystem for registrering og oppfølgning av leverandør. Systemet skal være en skybasert løsning (SaaS) som samler informasjon om alle byggeprosjekter hvor systemet benyttes, inkludert informasjon om leverandører/entreprenører og ansatte som befinner seg på den enkelte byggeplass. Det er videre behov for at løsningen støtter gjennomføring av seriøsitetskontroller, herunder støtte for oppfølging av påseplikten gjennom kontroll av lønns- og arbeidsvilkår i samsvar med GDPR. Systemet må samtidig kunne sammenkoble informasjon fra entreprenørene på byggeplassen med opplysninger hos blant annet Brønnøysundregistrene, StartBank og Arbeidstilsynets database for HMS-kort. Systemet skal også i sanntid kunne vise hvilke adgangskort/HMS-kort som benyttes på den enkelte byggeplass. Ved uregelmessigheter skal byggherren varsles om dette. Dette innebærer at tjenesten må ha integrasjoner mot så mange adgangskontrollsystemer som mulig, og som et minimum de mest brukte systemene på markedet. I tillegg skal systemet kunne registrer avvik og uønskede hendelser på byggeplass og føre statistikker på disse.

  Anskaffelsen er gjennomført uten konkurranse iht. FOA § 13-4 bokstav b nr. 2. og 3, ettersom ytelsen bare kan levers av én bestemt leverandør fordi konkurranse er umulig av tekniske årsaker eller leverandøren har en enerett. Hva gjelder systemet må dette inneha oppgitte funksjoner og mulighet for sammenkobling med andre systemer for å kunne gi Forsvarsbygg en effektiv mulighet til å registrere og følge opp opplysninger om leverandørene. Basert på Forsvarsbyggs innledende undersøkelser ble kun HMSREG AS med systemet HMSREG indentifisert som potensiell leverandør. Undersøkelsene baserte seg på fagpersonenes markedsforståelse, undersøkelser på nett, herunder Doffin hvor det fremgår at flere offentlige oppdragsgivere har gjennomført intensjonskunngjøring før inngåelse av kontrakt med HMSREG AS, og dialog med andre oppdragsgivere som tidligere hadde anskaffet samme system. Det ble likevel besluttet å gjennomføre en markedsundersøkelse (RFI) som ble publisert på Doffin og TED for å undersøke om det fantes ytterligere leverandører i markedet, se 2022-609224. Kun HMSREG AS har besvart markedsundersøkelsen, og tilfredsstiller samtidig alle krav. Videre vil det leveres et mindre omfang tjenester i forbindelse med implementering, drift og vedlikehold av systemet. Tjenestene krever kompetanse og tilgang til systemet. Det er påregnelig at andre leverandører ikke har nødvendige tilganger og/eller rettigheter til å kunne gjennomføre tjenestene. Dersom det likevel skulle vise seg at andre leverandører kan levere nevnte tjenester vil Forsvarsbygg kunne komme i en situasjon hvor feil blir møtt med ansvarsfraskrivelse fra både systemleverandør og tjenesteleverandør. Det anses følgelig å foreligge tungtveiende grunner for å også anskaffe tjenesteytelsene direkte fra systemleverandør. Eventuelle innsigelser bes rettes innen den 13.03.2023.
