  Det har oppstått tidskritiske behov på strekningen E6 Ranheim-Værnes som følge av en avbestilt totalentreprise kontrakt. Begrunnelse for kontraktsinngåelse vil være forskrift om offentlige anskaffelser (FOA) § 13-4 b) 2), dvs. at en «konkurranse er umulig av tekniske årsaker». Basert på oppdragsgivers undersøkelser og kjennskap til markedet er det vår klare oppfatning at vilkåret er oppfylt med følgende begrunnelse: • Behovet har oppstått som følge av en ikke-planlagt avbestilling av kontrakt. • De utpekte arbeidene er i all hovedsak påbegynt og vil ha behov for ferdigstillelse med bakgrunn i kritikalitet for fremdrift og sikre materielle verdier. • De utvalgte kontraktsparter har vært benyttet som underentreprenører for totalentreprisen E6 Ranheim-Værnes som ble før tidig avsluttet og er allerede etablert på anlegget. Det vurderes urimelig ressurskrevende dersom det skal etableres nye kontraktsforhold mot nye aktører, både ifht. grensesnitt og reetablering av rutiner ved nyoppstart av prosjektarbeider. • Arbeidet på delkontrakt 1 (Greenwall) vurderes til å ha en kompleksitet som vil gjøre det svært ressurskrevende å videreføre arbeidet med en ny entreprenør. • Begrenset tidsaspekt- behovet vil kun være å sikre materiell og minimere forsinkelser frem til nye entreprenører kan starte opp samlet arbeid etter gjennomførte konkurranser.
