  Avtalen som HDO har til hensikt å inngå, gjelder dels leie av lokaler for plassering av IKT-utstyr, dels datasentertjenester («housingtjenester»). Den er derfor en blandet kontrakt. Ytelsene - lokalleien og datasentertjenestene - kan ikke skilles fra hverandre på en objektiv måte. HDO skal da inngå en blandet kontrakt etter reglene som gjelder for ytelsen som utgjør kontraktens hovedelement, jf. anskaffelsesforskriften § 6-2 (2). Etter HDOs vurdering er det leien av lokaler som utgjør kontraktens hovedelement. Hensikten med avtalen er leie av arealer med tilhørende infrastruktur til plassering av IKT-utstyr. HDO står selv for drift og vedlikehold av dette utstyret. Datasentertjenestene er nært knyttet til leieobjektet og omfatter tjenester som også inngår i ordinære leieforhold. Etter HDOs vurdering er datasentertjenestene ikke av en slik karakter eller et slikt omfang at de fratar kontrakten karakteren av å være en leiekontrakt. Leie av lokaler faller utenfor anskaffelsesregelverket, jf. anskaffelsesforskriften § 2-4 bokstav. HDO mener derfor å ha hjemmel til å inngå avtalen direkte med Tietoevry Norway AS uten å gjennomføre konkurranse i medhold av anskaffelsesforskriften § 6-2 (2).
