  Det følger av forskrift om offentlige anskaffelser § 13-4 første ledd bokstav b nr. 2 at oppdragsgiveren kan gjennomføre en anskaffelse uten konkurranse dersom anskaffelsen gjelder ytelser som bare en bestemt leverandør kan levere fordi konkurranse er umulig av tekniske årsaker. Tekniske årsaker dekker eksempelvis omsetningsbegrensninger, produksjonsbegrensninger eller at det er en teknisk avhengighet mellom tidligere prosjekter hos oppdragsgiver og det som skal utføres. Unntaksbestemmelsen vil kunne brukes dersom det som skal kjøpes må fungere sammen med allerede innkjøpt utstyr. Intensivavdelingen ved Haugesund sjukeshus i Helse Fonna HF, har i dag 11 respiratorer, alle av fabrikat/modell Dräger/Evita. Disse skal suppleres med 1 ekstra. En respirator er et direkte livsopprettholdende utstyr. Dette krever full konsentrasjon fra brukernes side. Én av elleve respiratorer av et annet fabrikat/modell, vil medføre et helt annet brukergrensesnitt, og følgelig egen opplæring. Dette vil medføre at en respirator av et annet fabrikat blir sistevalget i behandlingen siden bruken denne vil oppleves «fremmed» for personellet. Når denne respiratoren blir sistevalget, vil kompetansen i bruk gradvis svekkes, og en er derfor inne i en «vond sirkel». Dette kan vi ikke tillate da intensivpasienter er sårbare og må skånes for brukernes usikkerhet rundt livsopprettholdende utstyr. I tillegg gjelder følgende argumenter: - Stadig behov for repeterende opplæring for å opprettholde kompetansen, gjelder ca 45 sykepleiere og 15 leger. Dette er resurskrevende i en travel hverdag. - Dobbelt lager av utstyrsspesifikke forbruksartikler - Dobbelt lager av reservedeler - Behov for opplæring av medisinsk teknisk personell - Én respirator gir lite grunnlag for å opprettholde kompetansen hos servicepersonell. Denne kompetansen er kritisk ved feil på utstyr i bruk. - For å oppnå samme type på alle respiratorer, vil utskifting av samtlige være et alternativ. Det er dog ikke mulig av økonomiske hensyn. Basert på det ovennevnte, stilles følgende krav til utstyret som skal anskaffes: - Personalet må være meget godt kjent med bruken av utstyret siden en respirator er et direkte livsopprettholdende utstyr. Dette kan kun oppfylles ved at avdelingen har en ensartet park av respiratorer. - Behovet for ekstra opplæring av klinisk og teknisk personell må være minimalt grunnet begrensninger i ressurser satt av til opplæring - Utstyret må ikke kreve eget forbruksmateriell siden det er begrensninger i kapasitet - Ekstraordinære kostnader, som ved utskiftning av en hel utstyrspark er ikke mulig på nåværende tidspunkt Det finnes bare en leverandør i markedet som kan oppfylle disse absolutte minstekravene til utstyret. På bakgrunn av ovennevnte, kan det ikke arrangeres konkurranse om levering av utstyret som skal anskaffes. Dette som følge av tekniske årsaker. Vilkårene for gjennomføring av anskaffelse uten konkurranse etter forskrift om offentlige anskaffelser § 13-4 første ledd bokstav b nr. 2 er derfor oppfylte. Karensfristen før signering av kontrakt settes til 26.05.2022 kl 23:59
