  Rammeavtale med Bertel O. Steen, inngått den 25.2.2021 omfattet modellen Peugeot Expert 4x4, som ble levert i Euro-klasse 6.2. Bilen hadde da en motorytelse på 150 hk. Peugeot vil nå produsere Peugeot Expert 4x4 i Euro-klasse 6.3, og motorytelsen er i den forbindelse redusert til 142 hk. Hverken Tensio AS eller leverandøren var på konkurransetidspunktet kjent med at produsenten på et senere tidspunkt ville foreta endringer i modellen som medførte redusert motorytelse. Hvilke mulige og sannsynlige endringer av tekniske spesifikasjoner som bilprodusentene eventuelt ville foreta, i tilknytning til blant annet justering av utslippskrav, ligger godt utenfor Tensio AS' faglige og tekniske kompetanseområde. Tensio AS utarbeidet det opprinnelige konkurransegrunnlaget på en aktsom måte, og det var ikke mulig for Tensio å forutse alle mulige endringer i kjøretøyenes tekniske spesifikasjoner og ta høyde for dette på en tilstrekkelig klar måte jf. forsyningsforskriften § 15-1 andre ledd. Det fremgår her at eventuelle endringsklausuler klart skal angi hvilke endringer som kan foretas, i hvilket omfang og på hvilke vilkår. Tensio AS kan ikke se at det ville være forholdsmessig å stille krav om at Tensio AS måtte sette seg inn i alle sannsynlige konsekvenser av oppdateringene i Euro-standarden, hvilke endringer som kunne bli aktuelle for de ulike bilmodeller, og å utforme endringsklausuler for alle disse alternativer. Tensio AS har vurdert praksis på området, som etter Tensio AS' underbygger at det ikke kan stilles krav om at Tensio burde ha forutsett de aktuelle endringene fra bilprodusentens side. Det vises her blant annet til avgjørelser fra Klagenemnda (KOFA) i sakene 2019/30, 2018/185 og 2017/56. Tensio AS finner på dette grunnlag at det er nødvendig med en endring av rammeavtalen, som følge av omstendigheter som Tensio AS ikke kunne forutse, jf. forsyningsforskriften § 24-1 første ledd bokstav d). Endringen innebærer ingen endring av kontraktens overordnede karakter, og det vises her til at endringen kun gjelder en av flere bilmodeller, samt at man antar at bilen fortsatt vil oppfylle sin tiltenkte funksjon. Tensio AS har videre innhentet en uavhengig vurdering fra Leaseplan Norge, som har vurdert at reduksjonen i hk ikke utgjør noe verdiminus for modellen. Endringen gjelder for gjenstående periode av rammeavtalen (tre år fra 1.1.21 med mulige opsjoner 1+1+1 år).
