  Gjeldende avtale om drift av passasjertransport på Bybanen mellom Bybanen AS og Keolis Norge AS ble inngått 11.07.2018, og drift av passasjertransport i henhold til kontrakten ble startet opp 01.07.2019. Et av tjenesteområdene i kontrakten er at Keolis Norge AS skal utføre avising på kontaktledning når det er nødvendig på grunn av værforhold på vinterstid. Bybanen AS vurderer det som mest hensiktsmessig for den totale driften av Bybanen at ansvar for avising av kontaktledning tilbakeføres til Bybanen AS. Kontraktsendringen gjennomføres prinsipalt i henhold til endringsklausul i kontrakten, jf. forsyningsforskriften § 24-1 (1) a) jf. § 15-1 (2). Endringsordre vil bli utstedt til Keolis Norge AS innen kort tid. Endringen gir en prisreduksjon som er lavere enn EØS- terskelverdi for tjenestekontrakter i forsyningsforskriften § 5-2 og 10 % av kontraktsverdien, og kan derfor på subsidiært grunnlag gjennomføres i medhold av forsyningsforskriften § 24-1 (1) b). Avising er en vedlikeholdsoppgave som ligger utenfor kontraktens kjerne, og som både med hensyn til godtgjørelse og tidsbruk utgjør en svært begrenset del av kontrakten. Kontraktsendringen endrer derfor ikke anskaffelsens overordnede karakter.
