  Anskaffelsen foretas uten konkurranse med grunnlag i eneleverandørunntaket i lov om offentlige anskaffelser og forskrift om offentlige anskaffelser § 13-4 bokstav b) nr. 2. Helse Vest IKT har foretatt markedsundersøkelser av tilgjengelige løsninger i EØS-markedet, og konkludert med at konkurranse om den aktuelle IT-løsningen ikke er mulig av lisenstekniske årsaker. Anskaffelsen gjelder nytt software til Helse Vest IKTs kjøreplattform for Oracle databaser. Helse Vest IKT har flere store systemer i produksjon som krever Oracle databaseteknologi, og på grunn av kompatibilitet med eksisterende løsninger må det tilbys et kjøremiljø for Oracle databaser. Helse Vest IKT har undersøkt ulike løsninger og modeller i markedet for den nye kjøreplattformen, herunder overgang til skybaserte plattformer sett opp mot Helse Vest IKTs behov for funksjonalitet. For å sikre tilstrekkelig stabilitet og fleksibilitet i plattformen over en tidsperiode på rundt 10 år, er det nødvendig for Helse Vest IKT å stille krav om lisensfleksibilitet. Helse Vest IKT mener at det kun er leverandøren Oracle Norge AS, med løsningen Oracle cloud@costumer som innfrir Helse Vest IKTs behov ved anskaffelsen. Dette begrunnes med at Oracles lisensbetingelser utenfor Oracle cloud/cloud@customer gir bruksrett til programvaren, men det er ikke en abonnementstjeneste. Abonnement av Oracle lisenser er kun tilgjengelig i Oracles egen cloud/cloud@customer, og kan dermed ikke tilbys av andre leverandører i markedet. Andre leverandører vil måtte følge Oracle Norge AS’ sine lisensbetingelser for å kunne oppnå samme leveranse, og disse lisensbetingelsene innebærer blant annet at: • Når du bruker Oracle-programvare, generelt, bør du være kompatibel når som helst. • Oracle lisensierer alle prosessorer der Oracle-programmer er installert og/eller kjører. • Prosessorberegningen brukes til å lisensiere alle prosessorer der Oracle-programmer er installert og/eller kjører. • Tilleggsprodukter som "Enterprise Options" og "Management Packs" må samsvare med antall lisenser for det tilknyttede produktet. • Lisensier toppbelastning, enten disse toppbelastningene skjer en gang om dagen eller en gang i året. Selv om andre leverandører vil kunne tilby en viss fleksibilitet, må andre leverandører forholde seg til Oracles lisensbetingelser hvilket vil medføre at leverandørene må være dekket for toppbelastning for database og alle opsjoner. Disse forskjeller mellom leverandørenes mulige lisensbetingelser gjør at det ikke vil være mulig å gjennomføre en konkurranse mellom flere leverandører om systemet. Det er derfor teknisk umulig å gjennomføre konkurranse, jf. anskaffelsesforskriften § 13-4 bokstav b nr. 2.
