  FOR § 9-3 bokstav b) nr 2 kan oppdragsgiver gjennomføre en anskaffelse uten konkurranse dersom: "Anskaffelsen gjelder ytelser som bare en bestemt leverandør kan levere fordi (..) konkurranse er umulig av tekniske årsaker (..)." Forutsetningen er at "det ikke foreligger rimelige alternativer og den manglende konkurransen ikke skyldes at oppdragsgiveren har tilpasset anskaffelsesdokumentene til en bestemt leverandør." Entur den eneste nasjonale konkurransenøytrale løsningen som skal selge billetter for hele kollektiv-Norge. Det foreligger ingen andre slike løsninger. Markedet har ikke selv etablert en slik løsning, og det er altså først gjennom et statlig prosjekt at en slik kanal er etablert. Det er også vanskelig å se at det finnes insentiver for andre levrandører å bygge et slikt tilbud. Den tiltenkte kontrakten gjelder kun salg gjennom to bestemte kanaler (nett og app). En avtale med Entur ikke utelukker Kringoms egne kanaler (eller salg gjennom andre sentrale kanaler eller mer lokale kanaler).
