Den opprinnelige kontrakten ble inng\u00e5tt den 1. april 2017 etter en forutg\u00e5ende anskaffelse. Avtalens varighet var oppgitt til minimum 4 \u00e5r, med mulighet for forlengelse for ett \u00e5r av gangen, inntil kontrakten hadde vart i totalt 8 \u00e5r. \nP\u00e5 tidspunktet for forrige anskaffelse var det ingen planer om \u00e5 legge ned dagens terminall\u00f8sning, og det var en forutsetning at man skulle ut p\u00e5 ny anskaffelse for samme tjeneste n\u00e5r avtaleperioden var g\u00e5tt ut, 01 april 2025. N\u00e5 er det imidlertid slik at Norsk Tipping har besluttet \u00e5 legge ned dagens terminall\u00f8sning. Pr dags dato teller antall terminaler 2990. Dette antallet reduseres fra m\u00e5ned til m\u00e5ned og er forventet \u00e5 g\u00e5 i null i l\u00f8pet av \u00e5ret 2027. Hva startantallet utgj\u00f8r 31.03.2025 er vanskelig \u00e5 si n\u00e5, men om dagens utvikling fortsetter vil det v\u00e6re betydelig lavere enn 2990.\nDette er dermed et viktig premiss inn i endringen som n\u00e5 er tenkt gjennomf\u00f8rt i den forlengede avtalen med Telia. Norsk Tipping anser det ikke for sannsynlig at flere leverand\u00f8rer ville deltatt i konkurransen dersom denne endringen med utfasing var kjent p\u00e5 tilbudstidspunktet, jf. FOA \u00a7 28-2 bokstav a. \nNorsk Tipping mottok videre tilbud fra to akt\u00f8rer, noe som var forventet. Etter Norsk Tippings vurdering ville endringen heller ikke medf\u00f8rt at en annen leverand\u00f8r ville ha vunnet konkurransen.\nP\u00e5 den andre siden kan det argumenteres for at 3 \u00e5r er en relativt sett lang forlengelse opp mot opprinnelig avtaletid p\u00e5 8 \u00e5r. Et viktig motargument er at i tre\u00e5rsperioden skal alts\u00e5 terminall\u00f8sningen fases ut og g\u00e5 i null. Skulle Norsk Tipping n\u00e5 g\u00e5tt ut p\u00e5 ny konkurranse ville b\u00e5de en ny tilbyder og Norsk Tipping bruke store summer p\u00e5 \u00e5 implementere ny l\u00f8sning, samt erstatte fullt brukbar hardware med ny. I dette perspektivet blir 3 \u00e5r sv\u00e6rt kort tid. Norsk Tipping anser dette for \u00e5 v\u00e6re en lite b\u00e6rekraftig l\u00f8sning, b\u00e5de \u00f8konomisk og milj\u00f8messig (Tildelingskriteriet Milj\u00f8 og b\u00e6rekraft 30%). P\u00e5 denne bakgrunn anser Norsk Tipping at den avtalte forlengelsen ikke utvider kontraktens omfang betydelig, jf. FOA \u00a7 28-2 bokstav c. \nEtter hvert som antall terminaler reduseres, s\u00e5 vil ogs\u00e5 leverand\u00f8rens godtgj\u00f8relse reduseres. Endringen vil dermed ikke endre kontraktens \u00f8konomiske balanse til fordel for leverand\u00f8ren, jf. FOA \u00a7 28-2 bokstav b. \n\n3 - Vurdering av alternativer mht. konkurranse\nNorsk Tipping har vurdert muligheten for \u00e5 utlyse ny konkurranse om levering av landsdekkende kommunikasjon. Som nevnt over ville dette v\u00e6rt en kortvarig kontrakt, sett opp mot kostnadene som kreves for gjennomf\u00f8ring av ny konkurranse og implementering. Norsk Tipping har estimert hva denne kostnaden vil v\u00e6re, se vurdering nedenfor.\nFor \u00e5 kunne levere kommunikasjon m\u00e5 det etableres ny infrastruktur. Det dreier seg om linjer, aksesspunkter, konfigurasjon, mm. Dette betyr at en eventuell ny leverand\u00f8r vil m\u00e5tte investere betydelig i ny infrastruktur. Ny infrastruktur (drift og trafikk-kostnader ikke medtatt) for 2900 kommisjon\u00e6rer er estimert til en kostnad i sjiktet 15 til 20 mnok. I tillegg vil en ny avtale m\u00e5tte ha en regulering som relativt raskt nedskalerer antall kommisjon\u00e6rer. Kostnaden for implementering av ny leverand\u00f8r vil dermed n\u00e6rme seg totalkostnaden for selve tjenesten over disse tre \u00e5rene. \nNorsk Tipping anser dette for \u00e5 v\u00e6re en l\u00f8sning som ikke fremmer effektiv bruk av samfunnets ressurser, jf. anskaffelsesloven \u00a7 1, og mener at det alternative caset vanskelig kan forsvares sett fra et \u00f8konomisk, samt kommersielt perspektiv. \n\n4 - Kontraktens verdi, for de 3 siste \u00e5rene av avtalen\nPer dags dato har eksisterende avtale et omfang p\u00e5 mindre enn 18 MNOK pr. \u00e5r. \nMed forventet reduksjon i antall terminaler, som forventes \u00e5 treffe nullpunktet i 2027, er den \u00f8konomiske verdien estimert til totalt 25-30 MNOK. Den opprinnelige avtalen gjelder frem til 31.03.2025. \nForlengelsen av avtalen inneb\u00e6rer at driftsavtalen vil fortsette \u00e5 l\u00f8pe etter den opprinnelige utl\u00f8psdatoen, med en varighet p\u00e5 3 \u00e5r fra og med 01.04.2025. \n\n2 - Rettslig vurdering \u2013 begrunnelse for intensjonskunngj\u00f8ringen\nAnskaffelsesregelverket har til form\u00e5l \u00e5 fremme effektiv bruk av samfunnets ressurser, jf. Anskaffelsesloven \u00a7 1. I dette tilfellet har Norsk Tipping gjennomf\u00f8rt en vurdering og anser en forlengelse av dagens avtale med Telia Norge AS for \u00e5 v\u00e6re den mest effektive bruken av samfunnets ressurser.\nDet f\u00f8lger av anskaffelsesforskriften (FOA) \u00a7 28-1 bokstav f at oppdragsgiver lovlig kan foreta en endring i en kontrakt uten \u00e5 gjennomf\u00f8re konkurranse dersom det gj\u00f8res endringer som \u00abikke er vesentlige\u00bb.\nVidere f\u00f8lger det av FOA \u00a7 28-2 at en endring alltid er vesentlig dersom endringen gjelder nye betingelser som ville ha f\u00f8rt til at andre leverand\u00f8rer potensielt kunne ha deltatt, eller at en annen leverand\u00f8r kunne ha blitt tildelt kontrakten. Videre vil en endring alltid v\u00e6re vesentlig dersom den endrer kontraktens \u00f8konomiske balanse til fordel for leverand\u00f8ren eller utvider kontraktens omfang betydelig. \nSp\u00f8rsm\u00e5let blir dermed hvilken betydning endringen ville f\u00e5tt dersom den var kjent p\u00e5 konkurransetidspunktet for den opprinnelige utlysningen. Den opprinnelige kontrakten ble inng\u00e5tt den 1. april 2017 etter en forutg\u00e5ende anskaffelse. Avtalens varighet var oppgitt til minimum 4 \u00e5r, med mulighet for forlengelse for ett \u00e5r av gangen, inntil kontrakten hadde vart i totalt 8 \u00e5r. \nP\u00e5 tidspunktet for forrige anskaffelse var det ingen planer om \u00e5 legge ned dagens terminall\u00f8sning, og det var en forutsetning at man skulle ut p\u00e5 ny anskaffelse for samme tjeneste n\u00e5r avtaleperioden var g\u00e5tt ut, 01 april 2025. N\u00e5 er det imidlertid slik at Norsk Tipping har besluttet \u00e5 legge ned dagens terminall\u00f8sning. Pr dags dato teller antall terminaler 2990. Dette antallet reduseres fra m\u00e5ned til m\u00e5ned og er forventet \u00e5 g\u00e5 i null i l\u00f8pet av \u00e5ret 2027. Hva startantallet utgj\u00f8r 31.03.2025 er vanskelig \u00e5 si n\u00e5, men om dagens utvikling fortsetter vil det v\u00e6re betydelig lavere enn 2990.\nDette er dermed et viktig premiss inn i endringen som n\u00e5 er tenkt gjennomf\u00f8rt i den forlengede avtalen med Telia. Norsk Tipping anser det ikke for sannsynlig at flere leverand\u00f8rer ville deltatt i konkurransen dersom denne endringen med utfasing var kjent p\u00e5 tilbudstidspunktet, jf. FOA \u00a7 28-2 bokstav a. \nNorsk Tipping mottok videre tilbud fra to akt\u00f8rer, noe som var forventet. Etter Norsk Tippings vurdering ville endringen heller ikke medf\u00f8rt at en annen leverand\u00f8r ville ha vunnet konkurransen.\nP\u00e5 den andre siden kan det argumenteres for at 3 \u00e5r er en relativt sett lang forlengelse opp mot opprinnelig avtaletid p\u00e5 8 \u00e5r. Et viktig motargument er at i tre\u00e5rsperioden skal alts\u00e5 terminall\u00f8sningen fases ut og g\u00e5 i null. Skulle Norsk Tipping n\u00e5 g\u00e5tt ut p\u00e5 ny konkurranse ville b\u00e5de en ny tilbyder og Norsk Tipping bruke store summer p\u00e5 \u00e5 implementere ny l\u00f8sning, samt erstatte fullt brukbar hardware med ny. I dette perspektivet blir 3 \u00e5r sv\u00e6rt kort tid. Norsk Tipping anser dette for \u00e5 v\u00e6re en lite b\u00e6rekraftig l\u00f8sning, b\u00e5de \u00f8konomisk og milj\u00f8messig (Tildelingskriteriet Milj\u00f8 og b\u00e6rekraft 30%). P\u00e5 denne bakgrunn anser Norsk Tipping at den avtalte forlengelsen ikke utvider kontraktens omfang betydelig, jf. FOA \u00a7 28-2 bokstav c. \nEtter hvert som antall terminaler reduseres, s\u00e5 vil ogs\u00e5 leverand\u00f8rens godtgj\u00f8relse reduseres. Endringen vil dermed ikke endre kontraktens \u00f8konomiske balanse til fordel for leverand\u00f8ren, jf. FOA \u00a7 28-2 bokstav b. \n\n3 - Vurdering av alternativer mht. konkurranse\nNorsk Tipping har vurdert muligheten for \u00e5 utlyse ny konkurranse om levering av landsdekkende kommunikasjon. Som nevnt over ville dette v\u00e6rt en kortvarig kontrakt, sett opp mot kostnadene som kreves for gjennomf\u00f8ring av ny konkurranse og implementering. Norsk Tipping har estimert hva denne kostnaden vil v\u00e6re, se vurdering nedenfor.\nFor \u00e5 kunne levere kommunikasjon m\u00e5 det etableres ny infrastruktur. Det dreier seg om linjer, aksesspunkter, konfigurasjon, mm. Dette betyr at en eventuell ny leverand\u00f8r vil m\u00e5tte investere betydelig i ny infrastruktur. Ny infrastruktur (drift og trafikk-kostnader ikke medtatt) for 2900 kommisjon\u00e6rer er estimert til en kostnad i sjiktet 15 til 20 mnok. I tillegg vil en ny avtale m\u00e5tte ha en regulering som relativt raskt nedskalerer antall kommisjon\u00e6rer. Kostnaden for implementering av ny leverand\u00f8r vil dermed n\u00e6rme seg totalkostnaden for selve tjenesten over disse tre \u00e5rene. \nNorsk Tipping anser dette for \u00e5 v\u00e6re en l\u00f8sning som ikke fremmer effektiv bruk av samfunnets ressurser, jf. anskaffelsesloven \u00a7 1, og mener at det alternative caset vanskelig kan forsvares sett fra et \u00f8konomisk, samt kommersielt perspektiv. \n\n4 - Kontraktens verdi, for de 3 siste \u00e5rene av avtalen\nPer dags dato har eksisterende avtale et omfang p\u00e5 mindre enn 18 MNOK pr. \u00e5r. \nMed forventet reduksjon i antall terminaler, som forventes \u00e5 treffe nullpunktet i 2027, er den \u00f8konomiske verdien estimert til totalt 25-30 MNOK.
